YOU'RE BOOKING A BOUDOIR SESSION
You are booking a boudoir session. That means you will be photographed in lingerie and likely nude, and posed in provocative ways. It is likely that I will touch you to adjust your clothing and hair or to direct a pose. I will probably see you with no clothes on. There will be absolutely no sexual activity allowed during your session. If any sexual activity occurs, your session will be terminated immediately and you forfeit your session fee with no opportunity for rescheduling.
YOU'RE AT LEAST 18 YEARS OLD
You must be 18 to do a boudoir session with me. You will provide your birthday at the end of this form for my records. I have the right to ID you before your session if I have doubt you are 18 years old. If you are unable to provide ID the session will be terminated and all funds paid to Bumble Boudoir are forfeited.
RESCHEDULING: 7 DAYS NOTICE TO ROLL OVER YOUR CREATIVE FEE
You may reschedule your photoshoot appointment 1 time. You must give me at least 7 days notice before your session date and start time to apply your sitting fee to the new appointment date. That new date must fall within 30 days of your original appointment or your session is considered cancelled. If you need to reschedule within 7 days of your session date, a rescheduling fee up to the amount of the creative fee may apply to cover "liquidated damages" I may incur.
CANCELLATIONS & NO SHOWS
If you CANCEL your portrait session or FAIL TO ATTEND your session for any reason and at any time, I will suffer losses that are difficult to ascertain. Any fees that have been paid Bumble Boudoir at this time are considered forfeited by you if you cancel your session or do not show for your appointment, not as a penalty but as payment toward unanticipated losses ("liquidated damages").
Should I need to reschedule your appointment for any reason and within any timeframe, your session fee will roll over to your new appointment without penalty. Should I need to cancel your appointment and we are unable to reschedule, I will refund your sitting fee in the manner it was paid, and you will receive your refund according to the policies and practices of that payment manner (ie, my credit card processor).
PLEASE CONTACT ME ASAP IF YOU'RE RUNNING LATE
Please be in touch with me by phone or text as soon as possible if you're running more than 10 minutes late to your photoshoot or ordering appointment. If you are 20 minutes late to your photoshoot appointment, your session will be shortened. If you are more than 30 minutes late, your appointment is considered cancelled and the cancellation policy applies.
YOU WILL APPROVE YOUR STYLING BEFORE PHOTOGRAPHY BEGINS
You are ultimately responsible for choices in wardrobe, makeup and hairstyle. Please be sure to tell us if you'd like anything changed with your hair and makeup before we start shooting. No refunds or reshoots are available if you dislike your styling in your final photographs.
AVOID SPRAY OR SELF TANNING WITHIN 7 DAYS OF YOUR SESSION
I prefer that you do not tan at all for your session. Should any tanning agent cause damage to studio props, linens, furniture or other items you will be liable for the cost of those items up to the full replacement cost. A retouching fee to bring your skin color back to normal requires an additional per-image editing fee.
I SHOW YOU ONLY MY FAVORITE PHOTOS
Deciding which photos to show you is part of my artistic process. The number of images and specific images presented is at my discretion according to Package chosen.
RETOUCHING: YOU WILL LOOK LIKE A HUMAN BEING
Every photo you are presented will be corrected for exposure, white balance, sharpness, brightness and contrast. Your photos will have blemishes and bruises removed, minor skin smoothing, softening of cellulite, wrinkles and stretch marks, and possibly minor body reshaping to correct errors I've made in posing. I do not take 10+ pounds off of you or 10+ years off of you or completely remove skin folds. Retouching beyond what I deliver in your final gallery may require a per-image retouching fee. I do not release unedited or raw images.
PURCHASNG PRODUCTS AT YOUR ORDERING APPOINTMENT
You will place an order for your boudoir products at an in-person or virtual ordering appointment within 7 days after your session. If you choose not to attend an ordering appointment within that timeframe, your photos will be deleted unless other arrangements have been made.
We may opt to do a virtual ordering appointment using Zoom or another technology. You must do this appointment on a computer (no phones or tablets) with a microphone and Internet service that allows you to stream Netflix. If you don't have this level of technology available to you, we will meet at a location we both mutually agree on.
Rescheduling, Cancellation and Late Policy for Ordering Appointments. Please be respectful of my time. If you need to reschedule your ordering appointment, or if you're running late, please let me know with as much advance notice as possible. If you no call/no show for your ordering appointment and/or you cancel your ordering appointment and do not reschedule your appointment for a mutually agreed upon date, your photos will be deleted unless other arrangements have been made. If you cancel or no show more then one time You will be required to pay a rescheduling fee of $75 in order to book your new apt. This fee is non-refundable.
PAYMENT FOR PRODUCTS IS DUE AT YOUR ORDERING APPOINTMENT
The total cost of your product order is due in full at your ordering appointment unless you otherwise mutually agreed upon.
Products and prices may change at any time and without notice. I collect Florida combined sales tax on all product orders.
ALL SALES ARE FINAL
No refunds or order changes are available once you've placed your order. All Sales are final. If you wish to add to your order you are allowed to do so. However taking anything off or downgrading is not allowed.
Cancelation of orders in not allowed. However if your order is to be canceled by my Discretion, your initial payment and any payments made are non-refundable as liquidated damages against losses I'm taking because I could have booked another client instead. Also, if I cancel your order, I will delete all of your images within 24 hours of the cancelation.
YOU MAY GIVE ME PERMISSION TO SHOW YOUR PHOTOS ... OR NOT
All clients are requested but not required to sign a "model release" to indicate if I have permission to share photos from your portrait session in my portfolio, marketing and social media. There is no advantage for giving me permission nor penalty for not giving me permission to share your portraits. Your permission is fully revocable in writing. I am not responsible for removing images from use beyond the places I have posted them.
By Signing this agreement, I hereby allow Paige Zauner of Bumble Boudoir to photograph me for my Boudoir session. I understand a boudoir session means the stated above in part one of this agreement.
YOU MAY NOT REPRODUCE, EDIT, SCREENSHOT OR PUBLISH IMAGES
All photographs produced during your photography session are protected by US Copyright Law. Any reproduction of my work, including taking screenshots during your ordering appointment or taking photos of finished items without my permission, and any unauthorized alteration of your portraits (cropping, changing colors, adding filters, editing in any software) is a violation of Copyright Law and will be prosecuted to the full extent of the law.
PRODUCT DESIGN & DELIVERY TIMEFRAMES DIGITAL PHOTOGRAPHS will be provided to the client upon receipt of payment.
PHOTO STORAGE
I do not guarantee to save and store your images beyond the time your order is delivered to you. I may delete them from my system at any time and without notice.
LIMIT OF LIABILITY
In the unlikely event that your photographs are lost, stolen, or destroyed for reasons beyond my control BEFORE your product order is placed, I will photograph you again if possible. If a re-shoot is not possible, my liability is limited to the return of all payments you’ve made to me minus any costs I've incurred. The limit of liability shall not exceed payments you've made.
AGREEMENT
This agreement between Bumble Boudoir, and the client, named below is governed by the laws of the State of Florida. Any disputes will be handled through arbitration.
I have read and accept the terms and conditions stated above. I am legally allowed to enter into binding contracts. I authorize this contract to be valid approval for photography sessions without additional signed contracts or written authorization.
